Dear Paw Terms of Service

1. Service Positioning

Welcome to Dear Paw. Dear Paw is a service operated by StoryKeepers Limited ("StoryKeepers", "we", "our", or "us").

Dear Paw is a platform that uses artificial intelligence (AI) to generate simulated conversations based on information users choose to provide about their deceased pets. The Service allows users to preserve memories of their pets, express thoughts and feelings, and engage in AI-simulated conversations based on the information they provide.

Dear Paw is not:

  • an animal communication service;
  • a psychic or mediumship service;
  • a spiritual communication service;
  • a veterinary service;
  • a medical service;
  • a psychological counselling or psychotherapy service.

All conversations generated by Dear Paw are created by artificial intelligence based on information voluntarily provided by the user. AI-generated responses are fictional simulations and must not be interpreted as real animal communication, spiritual messages, or statements of fact.

Subscription, billing, and refund matters are governed by our separate Subscription and Refund Policy, which is incorporated herein by reference.

2. Age Requirement

Dear Paw is intended only for individuals who are 18 years of age or older.

By using the Service, you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into these Terms of Service; and
  • the information you provide is accurate and complete.

Dear Paw does not knowingly collect personal information from individuals under the age of 18.

If we become aware that an account has been created by a person under the age of 18, we reserve the right to suspend or terminate the account and remove any associated information, subject to applicable legal requirements.

3. Emotional Crisis

Dear Paw has mechanisms related to user safety. Where the system determines that a message may involve a higher level of risk, Dear Paw may adjust the manner in which the AI responds and display a safety notice.

However, users acknowledge and agree that:

  • Dear Paw is not a crisis intervention service;
  • Dear Paw is not an emergency response service;
  • Dear Paw cannot guarantee that every emotional crisis, self-harm risk, suicidal thought or emergency situation will be identified correctly or in a timely manner.

If you believe that you or another person may be in immediate danger, you should immediately contact your local emergency services, qualified medical professionals, mental health professionals or other appropriate support organisations.

Dear Paw should never be relied upon as a substitute for emergency assistance.

4. Intellectual Property

You retain ownership of the content you submit to Dear Paw, including:

  • photographs;
  • stories;
  • memories;
  • pet information; and
  • any other content you voluntarily provide.

By submitting such content, you grant Dear Paw a limited, non-exclusive, non-transferable licence to use that content solely for the purpose of operating, maintaining and providing the Service to you.

This licence is limited to what is reasonably necessary to:

  • create your pet's AI personality;
  • generate AI conversations;
  • maintain your account;
  • provide customer support where applicable; and
  • operate the Dear Paw platform.

Dear Paw does not obtain ownership of your content.

Except as necessary to provide the Service, Dear Paw does not acquire:

  • copyright ownership of your content;
  • perpetual commercial exploitation rights; or
  • the right to sublicense your content to third parties.

5. Disclaimer

Dear Paw provides AI-simulated conversations based on information users choose to provide about their pets.

Dear Paw does not provide:

  • veterinary diagnosis;
  • veterinary treatment;
  • medical advice;
  • psychological counselling;
  • psychotherapy;
  • legal advice; or
  • financial advice.

AI-generated responses may:

  • contain inaccuracies;
  • misunderstand user input;
  • generate incorrect or incomplete information; or
  • produce responses that do not reflect factual events.

Accordingly, AI-generated content should not be relied upon as:

  • factual information;
  • professional advice;
  • medical advice;
  • psychological advice;
  • legal advice;
  • financial advice; or
  • evidence of genuine animal communication or supernatural communication.

Users are solely responsible for exercising their own judgment when using the Service.

6. Acceptable Use

By using Dear Paw, you agree to use the Service lawfully and responsibly.

You must not:

  • use the Service for any unlawful purpose;
  • attempt to compromise, interfere with or disrupt the operation or security of Dear Paw;
  • deliberately attempt to manipulate, exploit or attack the AI system, including through prompt injection, jailbreak attempts or similar techniques;
  • attempt to gain unauthorised access to Dear Paw, its systems, databases or user accounts;
  • upload, transmit or use any content that infringes the intellectual property rights, privacy rights or other legal rights of any third party.

StoryKeepers Limited, as operator of Dear Paw, reserves the right to investigate suspected violations of these Terms and, where appropriate, suspend or terminate access to the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, StoryKeepers Limited, as operator of Dear Paw, and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or emotional distress, arising out of or in connection with your use of the Service.

StoryKeepers Limited’s total aggregate liability to you for all claims arising from or related to the Service shall not exceed the amount you actually paid to Dear Paw (if any) during the twelve (12) months immediately preceding the claim.

This limitation applies even if Dear Paw has been advised of the possibility of such damages.

8. Governing Law and Dispute Resolution

These Terms of Service and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Hong Kong, and you hereby consent to the personal jurisdiction and venue of such courts.
